I the CLIENT by my submitting this order do agree to 100% complete acceptance of the all of the Payment TERMS & Additional TERMS of this agreement.
Payment TERMS: ** A 50% non-refundable deposit is required on all 1 REAL SOUND services, products and/or contracts. All outstanding balance(s) shall be due, in full, upon 1 REAL SOUND staff arrival at the event. All of the remaining balance shall be paid in full (prior to setup) in cash or certified check. No credit cards or personal checks will be accepted. Setup and tear down time can vary and will be an additional hourly charge of $50.00 per hour. Travel time will be an additional charge of $50.00 per hour (anything over 50 miles from Hickory, NC.).** If for any reason Payment in Full of any Balance due is not paid in full (prior to setup) in cash or certified check there may be (at the sole discretion of 1 REAL SOUND) a 10 day grace period to the CLIENT to allow all of the remaining balance to be paid in full (prior to setup) in cash or certified check. Under no circumstances should there be any outstanding balance(s) nor any balance due not paid in full by the CLIENT past 10 days of singing of this 1 REAL SOUND ORDER FORM.
Additional TERMS: Prices, products, services, rates and/or dates are subject to change without notice. In no event will 1 REAL SOUND (nor any staff or stock holder) be liable to you or anyone else for any lost profits, repairs, data and/or programs and/or other consequential, incidental, special or indirect damages and/or losses; even if such damages and/or losses result from any action(s) taken by 1 REAL SOUND (staff member, contracted staff and/or stock holder). You agree that the LIABILITY of 1 REAL SOUND and/or any of its staff , contracted staff and/or stock holders arising from any legal claim of any nature is not and will never be related in any way or connected in any way to any of the above products, equipment, hardware, software &/or services. Any legal and/or time expenses for 1 REAL SOUND are to be paid by the CLIENT ( 100% ) to 1 REAL SOUND at an hourly rate of $50.00 plus any related expenses (ie: lawyer , clerical staff, related services, court, time & any related fees and to be paid in a timely manner ( not to exceed 30 days)). You, the CLIENT, also acknowledge that an expressed repairman's lien is in effect on any equipment involved to secure the amount of repair, service, legal, time and/or any charges involved. Sorry no refunds 1 REAL SOUND does not warrant that the services, equipment and/or merchandise will meet your requirements or that the operation of said services, equipment and/or merchandise will be uninterrupted or error free. Should any of these TERMS and/or conditions be found as not permissible by any government please enforce all of the permissible TERMS of this agreement.
